California has legalized child prostitution. A new law, SB 1322 prohibits police from arresting minors engaged in prostitution. Critics say the law will be a disaster for children, and a boon for sex traffickers.

LOS ANGELES, CA (California Network) -- Sex traffickers must be rejoicing now that their victims cannot be intercepted by the police and arrested. SB 1322 prohibits police from detaining children engaged in prostitution.

The law is intended to protect children from arrest and from acquiring a criminal record. However, it has an unintended consequence, which is to make it harder to protect children from human traffickers. Worse, it incentivizes the use of children for sex trafficking since they cannot be arrested.


Police can still detain these children and attempt to question them and get them help, but there's little the police can do if they do not wish to cooperate. Police will still be required to file a report which can at least get the child's name to protective services. Unfortunately, the transient nature of sex trafficking also makes it difficult to locate these children and rescue them.

Historically, police have arrested these children and put them into a form of protective custody. District attorneys and judges have discretion whether to charge these children with a criminal offense. They can also order the children be placed under protection and into situations where they will not be victimized.

As for everyone else involved in a prostitution case, they are all subject to prosecution. Pimps and johns alike can still be arrested and prosecuted. But children will be able to engage in the deed without interference from law enforcement which makes it more likely they will be preferred victims.

And as pimps spend less time in jail, and make more money, the problem will only get worse over time.

The passage of this law reveals the incredible insanity, if not depravity, of the California state legislature. How is it that some of the most intelligent, well-to-do, and influential people in the state of California not think this through? Or did they think about it and not care?

Who supports such a law and why?

At a minimum, the law will need to be repealed or overturned, or new laws will be necessary to repair the damage of SB 1322. In the meantime, children beware, your state has made you more vulnerable than ever.
