LOS ANGELES, CA (California Network) -- California Governor, Jerry Brown has signed a bill that declares California to be a sanctuary state. State officials are now banned from questioning people about citizenship, and detaining people for immigration violations. The law also forbids state officials from transferring certain people to federal authorities for deportation. The law is the most aggressive push-back against President Trump out of similar laws passed in other states.
The law, which is called the "California Values Act," will turn California into a haven for illegal immigrants.
The state relies on these immigrants to perform all kinds of labor-intensive jobs from farm work to service jobs including washing, cooking, cleaning, gardening, construction, and more. California has more than two million illegal immigrants, and is home to a quarter of the nation's illegal immigrant population.
The chief problem with the law, is that nations have a right to secure their borders. Illegal immigration into other countries is not rewarded with protection and benefits. In some countries, illegal immigrants can face severe penalties.
By undermining the right of the nation to secure its borders, national security can be jeopardized.
There are no examples of this happening in the status quo, but it remains a vulnerability, and in the post 9/11 world, we must expect such vulnerabilities will eventually be exploited.
Another problem, with the law is that it is grossly unfair to millions of people who wait their turn in line and enter the country legally. The U.S. does permit immigration, although immigrants are required to undergo a vetting process which takes time. Those seeking asylum can enter much more quickly, but they must make their case to stay.
Federal immigration policy is not heartless, but it is firm. It should also be noted that the laws being upheld by the Trump administration were also upheld during the Obama administration. These are not Trump's rules, but Obama's. Why have states only recently become defiant?
Simple politics. By undermining the federal government, individuals such as Gov. Brown can make President Trump look bad, merely for doing his job as a president. This is valuable as people begin thinking about the 2018 mid-term elections.
In addition to politics, is smacks of treason. An act of defiance such as this not only defies the federal government, it defies the American people too.
One difference is a pledge by the Trump administration to withhold federal funding from self-declared sanctuary cities. The federal government has the right to withhold federal money from cities which defy federal directives. However, there is no similar threat for the states.
It is unclear how well the law will work. Some law enforcement agencies might defy the state and cooperate with federal agencies anyway. And federal agencies will also be permitted to work in the state. People nabbed by the feds will still face deportation.
