LOS ANGELES, CA (Catholic Online) - It all began when a lesbian woman demanded visitation rights for the three children she adopted.
One woman gave birth to three children, all of whom were adopted by her then-girlfriend, only to face a legal battle for custody and visiting rights after their breakup.
At the time, Alabama did not recognize same-sex adoption and ruled it invalid under Georgie law - where the adoption was legalized.
In Alabama, justices ruled Georgia law was not enough to support a "non-spouse to adopt a child without first terminating the parental rights of the current parents."
As the adoptive mother was not viewed as a legal guardian, she was not allowed to see the children following the breakup. The case brought to light several LGBT issues concerning laws designed for heterosexual couples only.
Despite the system's failure for the lesbian couple, the Alabama Supreme Court announced it now recognizes lesbian adoptions.
According to AL, The U.S. Supreme Court overturned the Alabama court's ruling.
On Friday, the Alabama Supreme Court's order read: "In In V.L., the United States Supreme Court held that the adoption decree appeared on its face to have been rendered by a court of competent jurisdiction and that that presumption of jurisdiction had not been rebutted.
"Inasmuch as there is no merit in E.L.'s other arguments asking this court not to enforce the adoption decree, we affirm the judgment of the Court of Civil Appeals."
The U.S. Supreme Court claimed the Alabama Supreme Court overstepped and would not be allowed to continue.
