Ted Cruz' father, Raphael Cruz, is known to as a Canadian citizen, and the presidential hopeful's mother, Eleanor Cruz, was an American citizen - but what if she wasn't? LOS ANGELES, CA (Catholic Online) - Ted Cruz is currently eligible to run for President of the United States despite being born in Canada because he is an American citizen, born to a woman of American citizenship.
Most Americans have no qualms with Cruz' lineage, citizenship or the fact that he is in the running for the presidency, but Republican Donald Trump has raised questions about Cruz' eligibility under the Constitution.
Article II of the United States Constitution states: "No person except a natural born Citizen, or a Citizen of the United States, at time of the Adoption of this Constitution, shall be eligible to the Office of President."Legal experts agree with Cruz that a child born abroad to an American citizen parent is a citizen at birth. The problem with Cruz's American citizenship came in the form of a document revealed by Breitbart indicating Eleanor was a Canadian citizen.
The document, which is a list of "registered Canadian voters," lists Cruz's parents as "Cruz, Eleanor, Mrs." and "Cruz, Raphael, self employed" at 920 Riverdale Avenue, South West in Calgary, Alberty.Jason Johnson, the chief strategist for Cruz for President, stated: "[t]he document itself does not purport to be a list of 'registered Canadian voters.' All this might conceivably establish is that this list of individuals (maybe) lived at the given addresses. It says nothing about who was a citizen eligible to vote.
"Eleanor was never a citizen of Canada, and she could not have been under the facts or the law. In short, she did not live in Canada long enough to be a Canadian citizen by the time Cruz was born in 1970: Canadian law required 5 years of permanent residence, and she moved to Canada in December 1967-only 3 years before Senator Cruz's birth."
Should anyone attempt to challenge Cruz's qualifications if he is nominated, most lawyers, according to the LA Times, believe the case will fall flat, as each did with Obama's qualifications.
