Mother claims she did not know son was being investigated for raping disabled sister.

In a sickening, heartbreaking case, a mother is charged with tampering with evidence in a rape case, specifically by obtaining an abortion for her 12-year-old daughter who has moderate mental retardation. The girl says she was raped and impregnated by her 19-year-old brother.

HOUSTON, TX (Catholic online) - In what appears to be tragedy compounded upon tragedy, a Houston family has been shattered by what appears to be an act of sexual depravity. The girl, whose identity is being withheld by authorities, and is described as being mentally disabled, told her father that her 19-year-old brother had sex with her.

After investigation by authorities, the brother was indicted on three counts of aggravated sexual assault of a child under 14 years old. The girl told authorities that he had sex with her previously on several occasions. 

The 50-year-old mother sought an abortion for her daughter, travelling out of state to do it. According to the probable cause affidavit against the mother, she told her daughter that the abortion was a procedure, "so it wouldn't hurt when the baby came out." The unborn baby was 22 weeks old at the time of the abortion. The abortion was done at a clinic in Ohio. 

Authorities have recovered the body of the unborn child and charged the mother for tampering with evidence. The mother's attorney responded that she did not know an investigation was ongoing at the time of the abortion, or that she was in fact tampering with evidence.

For his part, the brother charged in the case denies having sex with his sister, but tests on the aborted baby will reveal the truth. 

The girl, who is now 13, along with her sister, who is 12, have been removed from the home and placed in foster care. Authorities plan to find permanent adoptive parents for them.
 
Trial dates for the rape and evidence tampering charges have not been set.
