MUNTINLUPA CITY, PHILIPPINES (Catholic Online) - The Navy Personnel Command junked alleged attempts of punishing the military chaplain after reviewing his case, according to lawyer, Michael Berry, according to The Blaze.

"We are declaring it a total victory. The Navy categorically rejected and denied Modder's former commanding officer's request for punishment," stated Berry.

Berry added that the former commanding officer at the Navy Nuclear Power Training Command, Capt. JR Fahs was the one who recommended to the Navy Personnel Command that Modder should be "detached for cause" after other soldiers filed complaints against him.

The decision could have heavily made an impact on Modder's benefits. "You can loose benefits, etc. He's over 20 years now. He potentially stood to loose significant retirement benefits if that happened," noted Berry.

Modders' dilemma began when he was accused of allegedly speaking against homosexuality, telling a certain woman that "she was shaming herself in the eyes of God" for engaging in premarital sex, and allegedly berating an unmarried pregnant student.

Berry defended that these controversial complaints came to surface following claims that quite a number of sailors approached Modder to ask about faith and morality and his answers to them were based on what the Bible teaches.

"In one instance, an atheist sailor asked him if he believed in God," explained Berry. "In another, a female asked him what the Bible says about the fact that she's living and sleeping with her boyfriend. And then in another, a young gay sailor asked him about his views on homosexuality and he answered as the Assemblies of God asked him to answer."

With the case settled in Modder's favor, the lawyer stated that the Liberty Institute in turn filed a formal complaint against Fahs citing article 138, a military provision for filing a formal complaint or grievance which is still now pending.
